Ex-SIC MD battles dismissal and successor Agyenim-Boateng in court
Hollistar Duah-Yentumi, the former Managing Director of SIC Insurance Company Limited, has filed a lawsuit against the company and its newly appointed Acting MD, Mr. James Agyenim-Boateng, following her refusal to vacate her position after President John Dramani Mahama appointed Mr. Agyenim-Boateng as her replacement on January 27th.
In the lawsuit, which was filed on February 4th, Madam Duah-Yentumi argues that her contract, which is set to last for four years and expire on January 1, 2028, secures her position. She contends that any changes to her tenure must be approved by the company’s Board of Directors or by a resolution passed by shareholders during the Annual General Meeting.
According to her, the terms of her employment are clearly outlined in her contract with SIC Insurance. Madam Duah-Yentumi further asserts that her dismissal is unlawful as it violates the provisions of her contract, particularly Clause 7, which grants only the Board of Directors or the collective shareholders the authority to terminate her employment.
As a result, she maintains that the appointment of Mr. Agyenim-Boateng is both procedurally incorrect and illegal.
Madam Duah-Yentumi is seeking a High Court declaration that her dismissal is invalid and a ruling to reverse the appointment of Mr. Agyenim-Boateng, calling for her reinstatement as the rightful MD of SIC Insurance Company Limited.
In addition to her reinstatement, her legal team is demanding compensation for the full salary and benefits she is entitled to for the remainder of her contract.
