SC quashes re-collated results of Okaikwei Central, Ablekuma North, Tema Central & Techiman South
A five-member panel, led by Justice Gabriel Pwamang and comprising Justices Henrietta Mensa-Bonsu, Eric Gaewu, Henry Kwofie, and Richard Adjei-Frimpong, has quashed the re-collated results for the Okaikwei Central, Ablekuma North, Tema Central, and Techiman South constituencies.
The Supreme Court clarified that its order does not affect the results for Ahafo Ano North and Nsawam Adoagyiri constituencies.
The Court found that the trial judge had violated the NDC Parliamentary Candidates’ right to a fair hearing when they filed their application with the High Court.
This ruling directly counters the controversial re-collation and subsequent declarations made by the Electoral Commission (EC) for these constituencies.
Justice Pwamang further noted that while the re-collated results were quashed, the mandamus application still stands and must be heard and resolved by the High Court on Tuesday, December 31. However, the High Court judge who had earlier issued the re-collation order will not hear the mandamus case, as it must be assigned to a different judge.
The NDC had previously accused the trial judge of bias and procedural errors in ordering the EC to re-collate the election results for the disputed constituencies.
The December 20 ruling, now quashed, had directed the EC to re-collate results in nine constituencies where irregularities were alleged. This decision stemmed from a mandamus application filed by New Patriotic Party (NPP) parliamentary candidates, who argued that discrepancies in the results required verification for transparency and accuracy.
The EC has since complied with the order for seven constituencies, but the re-collation for Dome-Kwabenya and Ablekuma North remains unfinished.
