Yaw Brogya Genfi’s lawyers to sue Supreme Court Registrar

Lawyers for Yaw Brogya Genfi have written to the Supreme Court Registrar threatening to sue the Registrar for failing to serve the Clerk of Parliament since the past two years.

In a letter addressed to the Registrar of the Supreme Court a copy of which we have intercepted, Lawyer Isaac Minta Larbi who is Counsel for Yaw Brogya Genfi has complained bitterly about the failure of the Registrar to serve the Clerk of Parliament as required by law.

In his letter the Lawyer refers to the several letters that have already been written to the Registrar for the purposes of ensuring service of all documents that have been filed in the case but yet still despite all efforts to get the Beliefs of the court to serve they are dilly dallying.

The lawyer therefore gave the Registrar 30 days from the date of receipt of the letter to effect service risking court action if they fail to serve the Clerk of Parliament within the next 30 days.

It would be recalled that Yaw Brogya Genfi sued Hon. Habib Iddrisu MP for Tolon Constituency in November 2022 for standing to be elected as an MP when he did not qualify due to his criminal conviction in Australia for fraud. Since November 2022 the Supreme Court Registrar claims they cannot find Hon. Habib Iddrisu to serve him even though service can be effected on the Clerk of Parliament and once served, the documents will be given to Hon Habib Iddrisu for the case to proceed.

In the letter, Lawyer Isaac Minta Larbi states that the office of Parliament is a government office which is open during business hours for which reason there’s no excuse for the failure of the court bailiffs to serve.

Strangely, since the past two years that the writ was issued the Registrar of the Supreme Court claims they are unable to serve Hon Habib Iddrisu.

Meanwhile we are all aware of the recent Richard Sky case and Hon Dafeamekpor cases which have all been served on Parliament.

It is therefore extremely curious as to why the Supreme Court cannot serve Hon. Habib Iddrisu.

According to Lawyers for Yaw Brogya Genfi if service is not effected on the Clerk of Parliament in the next 30 days a Mandamus Application would be filed for an Order compelling the Registrar to serve the Clerk of Parliament in accordance with procedures.
