Regional Court Throws Out All Seven Claims
The ECOWAS Community Court of Justice has dismissed all seven claims brought by former Chief Justice Gertrude Torkornoo against the Republic of Ghana. The decision was disclosed by Deputy Attorney-General and Minister for Justice, Justice Srem-Sai, who announced that the regional court found no merit in the allegations presented by the former Chief Justice.

Case Stemmed from Suspension and Removal Challenge
Justice Torkornoo had petitioned the ECOWAS Court following her suspension and subsequent removal from office. She argued that the actions taken against her violated her rights under the African Charter on Human and Peoples’ Rights.
The matter had previously gone through several procedural stages before the court, including the consideration of preliminary objections and other legal applications filed during the proceedings.

Court Rejects US$10 Million Compensation Request
In addition to seeking declarations on alleged rights violations, Justice Torkornoo requested compensation amounting to US$10 million.
However, according to Justice Srem-Sai, the court declined to award any damages after determining that Ghana had not infringed upon any of the rights cited in the application. Quoting the court’s ruling, the Deputy Attorney-General noted that: “In light of the Court’s conclusions that Ghana has not violated any of the Applicant’s rights under the African Charter as alleged, the Court makes no decision on reparations.”

Landmark Ruling Ends ECOWAS Proceedings
The judgment effectively brings to a close the legal challenge pursued by Justice Torkornoo before the ECOWAS Court. With all claims dismissed and no compensation awarded, the regional court has concluded its involvement in the matter, bringing finality to the proceedings at the ECOWAS level.
Government Praises Legal Team
Reacting to the outcome, Justice Srem-Sai commended the legal team that represented Ghana before the regional court. He particularly praised the state attorneys involved in the case, highlighting the extensive research, preparation, and legal work undertaken in defending the country’s position.
According to the Deputy Attorney-General, the team’s efforts played a significant role in securing what the government views as a successful outcome for the Republic of Ghana.

Significance of the Decision
The ruling represents an important legal victory for the Ghanaian state, affirming its position in a high-profile dispute involving the country’s former Chief Justice. It also underscores the role of the ECOWAS Court in adjudicating claims relating to alleged violations of human rights and constitutional governance within member states.
